OFCCP Plans to "Get Tough" on Government Contractors
Recently, the Office of Federal Contract Compliance Programs ("OFCCP") has emphasized a new "get tough" approach to enforcement. The agency is flexing its muscle due to recent media reports that corporate downsizing has had a disproportionate adverse effect on minorities and is working to determine if illegal conduct has occurred among government contractors. Additionally, OFCCP has proposed regulations which would increase penalties and increase the agency's enforcement tools, including pre-hearing sanctions (e.g. cessation of contract payments), and assessment of monetary penalties other than backpay and fixed term debarments.
